Our process ensures complete transparency and constant reporting on the status of the sale of the property in question and providing all information relevant to the process to the Court, parties and their respective attorneys.  As an integral part of being unbiased and transparent, all parties and Attorneys are included on all communications regarding the sale of the property in receivership.

Having our own in-house counsel with specific experience and training in receivership law and its application to real estate transactions ensures you have the expertise needed for this type of case. Following the simple appointment of RPRS as the receiver in a real estate transaction, our counsel will represent RPRS to the Court and will handle all pleadings, filing, and reports necessary through the closing of the sale, distribution of the proceeds (as directed by the Court or by agreement of the parties approved by the Court) and ending of the receivership appointment.  For the party requesting receivership to enforce the Court ordered liquidation of the property in question, this effectively eliminates ongoing attorney’s fees on this issue.  It also eliminates the appearance that the Receiver is controlled by the attorney who sought receivership. 

We provide all of these services at no additional cost to either party outside of the traditional real estate commissions charged in a real estate transaction.  Unfortunately, in some situations, one party, through his or her unreasonable actions, may necessitate litigation in order to enforce the purpose of the receivership.  In that event, our in-house counsel may seek additional compensation for such costs by the Court at the expense of the offending party.
