Real Property Receivership provides an innovative service designed to address the typical frustrations and difficulties experienced by Parties, Attorneys and Courts in real estate based transactions requiring receivership. Our team of Realtors and Attorneys work together seamlessly to provide experienced, knowledgeable Receivers backed by their own in-house counsel.

The Problem.

The receivership process can often be, or appear to be, biased. Unfortunately, with unknowledgeable Receivers what typically happens is the “obstructive party” gets cut out of information because the receiver is primarily communicating with the attorney for the moving party. Going through receivership can cost one or both of the parties’ thousands of dollars in attorney’s fees that they would probably prefer not to incur on this particular issue. Due to the relatively rare need for these receiverships, qualified, experienced Receivers may be difficult to identify and, indeed, are rare themselves.

Receivership has historically presented several key challenges:

  • The process can be, or at least appear to be, biased. Typically, the “obstructive Party” gets cutout of information regarding the transaction because the Receiver is exclusively communicating with the Party forcing the sale.

  • Going through receivership can cost the Parties thousands of dollars in Attorney’s fees.

  • Due to the relatively rare need for these receiverships, qualified, experienced Receivers may be difficult to identify and, indeed, are rare themselves. All too often, unqualified Realtors find themselves acting in the capacity of a Receiver with little knowledge regarding the requirements of receivership or how to best go about the responsibilities of a Receiver.

By doing so, we drastically reduce, if not eliminate, Attorney’s fees following the appointment of RPRS as the Receiver.

In almost all scenarios, we provide this service at no additional cost to either Party outside of the traditional real estate commissions charged in a real estate transaction.

RPRS provides an innovative service designed to address the typical frustrations and difficulties experienced by Parties, Attorneys and Courts in real estate based transactions requiring receivership. Our team of Realtors and Attorneys work together seamlessly to provide experienced, knowledgeable Receivers backed by their own in-house counsel.

Our team knows first hand the frustrations experienced with finding true, knowledgeable Receivers. Even more, obtaining and maintaining the receiverships when one party’s spouse or former spouse is doing everything he or she can to frustrate the sale of a property.  Oftentimes, attorneys find themselves having to do all the work. In addition, that client then has to pay additional attorney fees. Plus, most attorneys don’t have a vast amount of experience when it comes to receivership. 

Finding receivers can be difficult and it’s common that the court just ends up appointing a local real estate agent that knows little to nothing about the intricacies and requirements of receivership in these transactions.

Our goal was to form a company that addressed the common frustrations for parties, attorneys and Judges for these type of transactions.  This would require a TEAM of both lawyers and Realtors working together.  That’s where we come in.
